نفاذ حقوق الامتياز الخاصة العقارية في مواجهة الدائنين وفق أحكام القانون المدني الجزائري.

Résumé: أكد المشرع المدني الجزائري في نصوص المواد 900، 1000، 1001 منه، على الأصناف الثلاثة لحقوق الامتياز الخاصة العقارية وهي: امتياز بائع العقار، امتياز متقاسم العقار، امتياز المقاولين والمهندسين المعماريين، كحقوق عينية تبعية، غير قابلة للتجزئة واردة على العقار تقرر بمقتضى نص قانوني (المادة 982 مدني)، وتسري على حقوق الامتياز العقارية، أحكام الرهن الرسمي بما لا يتعارض مع طبيعتها وهذا خاصة فيما يتعلق بأحكام التطهير وقيدها وشهرها حتى تسري نافذة في مواجهة الغير (المادة 986)، مما يضمن لها مرتبتها أمام كل الديون الممتازة، وينقضي حق الامتياز العقاري بنفس طرق انقضاء الرهن الرسمي (المادة 988)، وهي انقضاؤه بطريقة تبعية أو بطريقة أصلية. The Algerian civil legislator emphasized the three types of private real estate concessions, in the texts of Articles 900, 1000, and 1001 thereof, which are: the property seller’s concession, the property sharing concession, the contractors’ and architects’ concessions, as rights in kind, indivisible, contained on the property decided by a legal text (Article 982 civil), and on real estate concession rights: the provisions of the official mortgage in a manner that does not contradict their nature, and this is especially with regard to the provisions of purification, registration and publicity so that it becomes effective against third parties (Article 986), which guarantees its rank against all preferred debts. The right of real estate lien expires in the same manner as the official mortgage (Article 988), which is its expiration in an auxiliary or original manner.
