حماية الأسرى بين الشريعة الإسلامية واتفاقيات جنيف

Résumé: حاولت من خلال هذه الدراسة معالجة موضوع من أهم الموضـوعات وهـو حمايـة الأسـرى، وبيّنت من خلال هذه الدراسة الإطار التنظيمي لحماية أسرى الحرب على الصعيد الدولي المتمثل في اتفاقيات جنيف وعلى صعيد التشريع الإسلامي، مستعرضا بذلك ماهية الأسرى(مفهوم الأسرى ووضعهم التاريخي، الفئات التي ينطبق عليها وصف أسرى الحرب، الفئات التي لا يجوز أسرها...)، كما تطرقت إلى وضع الأسرى من منظور الشريعة الإسلامية واتفاقيات جنيف(قواعد معاملة الأسرى، ضمانات تطبيق قواعد هذه المعاملة والجزاء المترتب على الإخلال بها). وفي الأخير خلصت إلى أن الشريعة الإسلامية قد سبقت المجهودات الدولية المكثفة حول حقوق الأسرى وحمايتهم بأربعة عشرة قرنا، كما أن الأسر الحربي لا يعد انتقاما أو عقابا، ولكنه لا يعدوا أن يكون وسيلة لمنع الأسرى من العودة إلى الالتحاق بقواتهم وحمل السلاح مرة أخرى في وجه الدولة الآسرة، كما أنه لا بد من البحث عن وسائل بديلة لحماية الأسرى كتعيين لجنة خاصة تابعة للأمم المتحدة تقوم بدور الدولة الحامية، وكذلك منح صلاحيات أوسع للجنة الدولية للصليب الأحمر التي تؤدي خدمات كبيرة للأسرى، كما يجب على الدول العربية أن تسارع بسن التشريعات التي تجرم وتعاقب انتهاكات القانون الدولي الإنساني حتى تستقيـم مع الالتزامات الدولية ونتجنب الوقوع تحت طائلة المسؤولية الجنائية الدولية.In this study, I have tried to address one of the most important topics, namely, the protection of prisoners. The study examined the legal framework for the protection of prisoners of war at the international level represented by the Geneva Conventions and the Islamic legislation. Describing the prisoners of war, the categories that can not be captured ...), and also referred to the situation of prisoners from the perspective of Islamic law and the Geneva Conventions (rules of treatment of prisoners, guarantees of the application of the rules of this treatment and the penalty of breach). Finally, it concluded that Islamic law has preceded intensive international efforts on the rights of prisoners and their protection for fourteen centuries. War families are not considered retaliation or punishment, but they are no longer a means of preventing prisoners from returning to their forces and taking up arms again in the face of the state. As well as the granting of broader powers to the International Committee of the Red Cross (ICRC), which provides great services to prisoners. The Arab countries should also accelerate the enactment of legislation that criminalizes and punishes violation International humanitarian law, even upright with international obligations and avoid falling under penalty of international criminal responsibility
