Résumé: يعتبر عقد الزواج من أهم العقود التي يبرمها الإنسان في حياته، فكان من الضروري أن تسبقه الخطبة، و هي مرحلة تمهيدية للتدبر و التفكير، و التأكد من رغبة الطرفين لإتمام عقد الزواج من عدمه. وما دامت الخطبة مرحلة للتعارف والتشاور، ففي خلالها غالبا ما يتم تبادل الهدايا بين الخطيبين، وقد يُقدّم الخاطب لمخطوبته بعض المهر أو كله تحضيرا للزواج، لكن هذه الخطبة قد تنتهي بالعدول عنها من أحد الطرفين، مما قد يسبب ضررًا للطرف الآخر، الذي تتأكد أحقيته في التعويض. The marriage contract is considered one of the most important contracts that a person makes in his life, so it was necessary for it to be preceded by the engagement, which is a preliminary stage for reflection, and to make sure of the desire of both parties to complete the marriage contract or not. And as long as the engagement is a stage for acquaintance and consultation, during which gifts are often exchanged between the two betrothed, and the betrothed may offer his betrothed some of the dowry or all of it in preparation for marriage, but this engagement may end by one of the parties, which may cause harm to the other party, whose eligibility for compensation is confirmed.
