حماية المستهلك الالكتروني بطريق حق العدول - دراسة تحليلية مقارنة-

Résumé: تهدف هذه الدراسة إلى تسليط الضوء على حق المستهلك الإلكتروني في العدول عن العقد ، باعتباره أحد أهم الآليات القانونية التي استحدثتها التشريعات المقارنة الحديثة ، بهدف توفير حماية فعالة للمستهلك في عقود التجارة الإلكترونية في مواجهة خبرة المهني أو المحترف الذي يلجأ إلى وسائل الدعاية و الإعلانات الساحرة للترويج للسلع و الخدمات ، و هو ما قد يؤثر على نفسية و إرادة المستهلك ، فيقدم هذا الأخير على التعاقد بتسرع و بدون تبصر أو تفكير كاف. و نظرا لكون حق العدول عن العقد يمس بأحد أهم المبادئ الأساسية للعقد ، و هو مبدأ القوة الملزمة للعقد ، فقد حرصت مختلف التشريعات المقارنة على تنظيم ممارسة هذا الحق بوضع مجموعة من الاستثناءات و الضوابط. Abstract: This study aims to highlight the right to retract the contract, as one of the most important legal mechanisms introduced by modern comparative legislation with the aim of providing effective protection to the consumer in electronic commerce contracts in the face of the experience of the vocational or professional who resorts to the means of publicity and charming ads to promote goods and services that may affect the psychology of the consumer`s will, the latter contracts hastily and without sufficient vision or thinking. Since the right to retract the contract affects one of the most fundamental principles of the contract, the principle of binding force of the contract, the various comparative legislations have been careful to regulate the exercise of this right by establishing a set of exceptions and controls.
