Résumé: قد يتعرض المتعامل المتعاقد إلى جزاءات نتيجة عدم احترام المعايير البيئية للصفقة العمومية، فقد تكون هذه الجزاءات إما إدارية تفرضها الإدارة، كوقف النشاط أو سحب الترخيص أو فرض غرامات مالية أو قد تكون هذه الجزاءات قضائية ناجمة عن دعوى القضاء الاستعجالي التي تدخل في طياتها سلطة توجيه الأوامر وسلطة فرض الغرامة التهديدية وسلطة تأجيل إمضاء العقد، أو دعوى القضاء الكامل التي تكون في حالة نشوب المنازعات التقنية.
