الجزاءات الإدارية غير المالية المترتبة عن المساس بالبيئة

Résumé: تعتبر الجزاءات الإدارية غير المالية سلطة هامة خولها المشرع للهيئات الإدارية بهدف حماية البيئة, وهي تتمثل في كل من الإخطار و هو جزاء غير مالي لا يؤدي إلى وقف النشاط, بالإضافة إلى التوقيف المؤقت للنشاط وسحب الترخيص و أحاط هذه السلطة بجملة من القيود و الضوابط ينبغي على الإدارة المتخصصة مراعاتها قبل توقيع الجزاءات, وهي تنقسم إلى ضوابط شكلية و إجرائية وضوابط موضوعية بهدف ضمان سلامة وصحة الجزاءات الإدارية البيئية.
