حماية المرأة من العنف في الجزائر:بين النصوص القانونية و الممارسات الميدانية

Résumé: ملخص: تنص المعايير الدولية على أن العنف ضد المرأة هو شكل من أشكال التمييز،وتحث بالتالي الدول على اتخاذ الإجراءات اللازمة لمنع أعمال العنف ضد المرأة ،والتحقيق فيها والمعاقبة عليها سواء اقترفتها الدولة أو جهة أخرى من غير الدولة. وعليه فمن الضروري بمكان متابعة ودراسة أهم العقبات التي تقف سدا منيعا أمام حرمان النساء من نيل حقوقهن ،والتمتع بكرامتهن ،وإزالة كافة المعوقات التي تعكر صفو عيشهن. وهذا ما يحاول البحث تقديمه وذلك من خلال معرفة أهم الأسباب التي تؤدي إلى تعنيف المرأة ،وتحديد أشكال وصور العنف الممارس ضدها،وكذلك الوصول إلى أهم الاستراتيجيات التي ينبغي أن تتبع لضمان الحصول على بيئة محفزة تمنع الوصول للمرأة والاعتداء عليها ،معتمدين عل القوانين الجزائرية كنموذج. الكلمات المفتاحية: العنف ضد المرأة ،القوانين الدستورية ،الاتفاقيات الدولية ،الاستراتيجيات المتبعة ،الجزائر. Abstract : International standards state that violence against women is a form of discrimination, and therefore states are urged to take the necessary measures to prevent, investigate and punish acts of violence against women, whether they are committed by the state or by another non-state party. Therefore, it is necessary to follow up and study the most important obstacles that stand in the way of an impenetrable barrier to denying women their rights, enjoying their dignity, and removing all obstacles that disturb their lives. This is what the research tries to present by knowing the most important causes that lead to violence against women, identifying the forms and images of violence practiced against them, as well as reaching the most important strategies that should be followed to ensure a stimulating environment that prevents access to and abuse of women, relying on Algerian laws as a model.
