ضمانات حماية حقوق الانسان و حرياته الاساسية في ظل التعديل الدستوري 2020 (المحكمة الدستورية)

Résumé: تضمن التعديل الدستوري لعام 2020 مجموعة كبيرة من حقوق الإنسان و حرياته الأساسية مطابقة لما جاءت به الاتفاقيات و المعاهدات الدولية المتعلقة بحقوق الإنسان ،واستحدث المحكمة الدستورية كجهاز يتولى الرقابة على دستورية النصوص القانونية المتعلقة بحقوق الإنسان و حرياته الأساسية و ضمان عدم انتهاكها عن طريق الدفع بعدم الدستورية كأحد أساليب الرقابة القضائية على دستورية القوانين ،وفقا لضوابط و شروط حددتها المادة 195 منه في انتظار صدور القانون العضوي المتعلق بها . Abstrat The most recent constitutional amendment of 2020 in Algeria included a series of human rights and public freedoms in the text of treaties and human rights conventions. The Constitutional Court was established to monitor the conformity of legal texts on human rights and to ensure that they were not violated by arguing that they were unconstitutional.
