تصنيف الأصوليين للأفعال الإنجازية في الخطاب الشرعي

Résumé: ملخص: يحاول هذا المقال أن يطرح الأساس اللغوي الذي اعتمده علماء أصول الفقه في تصنيف الأفعال الإنجازية في الخطاب الشرعي، انطلاقاً من اعتمادهم على ثنائية الخبر والإنشاء، وبحثهم في المعايير التي على أساسها قدّموا تصنيفهم، ويهدف المقال إلى إعادة قراءة التراث اللغوي الذي قدّمه الأصوليون في ضوء ما تتيحه نظرية الأفعال الكلامية في اللسانيات التداولية المعاصرة وفق منهج المقاربة. In this article we try to prove the linguistic basis adopted by the Usool al-fiqh scholars in the classification of performatif acts in the legal discourse, based in the duality of “Al-khabar”(Predicate) and “Al-Inchaa”(Composition), and their research in the norms of classification. And this article aims to re-read the linguistic heritage presented by the Usool al-fiqh scholars in the light of the speech acts theory in the contemporary pragmatic linguistics according to the approach method.
