مسؤولية الحماية للمدنيين في النزاعات المسلحة الداخلية : شرعية التدخل العسكري في ليبيا !

Résumé: يقترب مفهوم مسؤولية الحماية من مفهوم التدخل الإنساني، إذ انه تقوم مسؤولية الحماية على أساس إنقاذ الشعوب التي تواجه أخطار الحروب وانتهاكات حقوق الإنسان من خلال تقديم المعونة لهم سواء عن طريق الدول أو المنظمات الدولية، ولقد أثار هذا المفهوم جدلا واسعا لحدوثه في مناطق و عدم حدوثه في مناطق أخرى، رغم توفر نفس الأسباب لتفعيل مسؤولية حماية المدنيين، عندما ترتكب في حقهم جرائم تعذيب وإبادة دون قدرة سلطات الدولة التابعين لها على توفير الحماية الكافية لهم، هذا المقال يجيب على إشكالية مسؤولية الحماية للمدنيين في النزاعات الداخلية من خلال التركيز على حالة ليبيا. The concept of the responsibility to protect is close to the concept of humanitarian intervention, because the responsibility to protect rests on rescuing people who face the dangers of war and human rights violations by providing them with assistance, be it through States or international organizations. This concept has caused widespread controversy as to its occurrence in one region and its non-occurrence in other regions, although the same reasons exist for activating the responsibility to protect civilians, when they commit acts of torture and crimes of extermination against them without the authorities of their state being able to provide them with adequate protection. This article addresses the issue of the responsibility to protect civilians in internal conflicts by focusing on the case of Libya.
