Résumé: ملخص: يحتل موضوع عقد امتياز الأراضي الفلاحية مكانة هامة في التشريع الجزائري مردها الى الأهداف المرجوة منه في الحفاظ على الأملاك الوطنية والأراضي الفلاحية، كما أنه من شأنه المساهمة في النهوض بقطاع الفلاحة وجعله بديلا عن المحروقات في الاقلاع بالتنمية الاقتصادية، ويعتبر حق الامتياز نظام جديدا في السياسة العقارية المنتهجة منذ الاستقلال، لذلك أولاه المشرع الجزائري أهمية بالغة في الأحكام التي تنظمه، من خلال تعزيز الدور الرقابي لهيئات الدولة في استغلال الأراضي الفلاحية، وكرس حق استرجاع الأراضي الفلاحية عند الاخلال إخلال صاحب الامتياز بالالتزامات الملقاة على عاتقه.
