قيود تعد الزوجات بين الفقه الإسلامي وقانون الأسرة الجزائري

Résumé: ملخص: تهدف هذه الدراسة إلى تبيان أن كلا من الفقه الإسلامي وقانون الأسرة الجزائري أوليا أهمية لتعدد الزوجات، وهو ما أنتج تباينا في أوجه التوافق والاختلاف بين كل منهما في تنظيم قيود تعدد الزوجات وجزاء تخلفها، وأيضا أسهم في معرفة النقائص والتناقضات التي جاء المشرع، وتبيان كيفية تعامل رجال القانون معها. تم التوصل إلى أن قانون الأسرة الجزائري وإن كان موافقا للفقه الإسلامي في غالبية قيود تعدد الزوجات، إلا أنه زاد عليها جملة من القيود الاجتهادية التي يصعب تحققها مجتمعة، وعدم تحقق قيود تعدد الزوجات القانونية لا يعني بطلان الزواج في جميع حالاته، إنما يمكن استدراك هاته القيود عن طريق إتمام إجراءات الدخول. Abstract: This study aims to show that both Islamic jurisprudence and Algerian family law give importance to polygamy, which produced a discrepancy in the aspects of compatibility and differences between each of them in regulating the restrictions of polygamy and the penalty for its failure, and also contributed to the knowledge of the shortcomings and contradictions that the legislator came, and to show how to deal with Lawmen with her. It was concluded that the Algerian family law, although it is in agreement with Islamic jurisprudence in most of the restrictions on polygamy, but it has added to them a number of discretionary restrictions that are difficult to achieve collectively, and the failure to achieve the legal restrictions of polygamy does not mean the invalidity of marriage in all its cases, but these restrictions can be remedied By completing the login procedures.
