إشكالية العلاقة بين المحكمة الجنائية الدولية و مجلس الأمن الدولي

Résumé: الملخص: يُنظر إلى المحكمة الجنائية الدولية عمومًا على أنها إنجاز عظيم للقانون الدولي العام لكونها أول مؤسسة قضائية دولية دائمة تعترف بالمسؤولية الفردية لعدد من أفظع الجرائم الدولية. ومع ذلك ، مثل أي مؤسسة قضائية أخرى، فإن الاستقلال عن تأثير الهيئات الأخرى يعتبر جزءاً لا يتجزأ من كفاءتها وشرعيتها ومصداقية قراراتها. في هذا الصدد ، فإن العلاقة بين المحكمة الجنائية الدولية ومجلس الأمن كانت دائماً موضوع جدلي. إن مشكلة البحث تظهر من خلال وجود إنقسام حول فعالية العلاقة بين مجلس الأمن الدولي وبين المحكمة الجنائية الدولية، لا سيما في ظل ما يمكن رؤيته على أنه تأثيرسلبي لمجلس الأمن الدولي على المحكمة في أداء دورها في تحقيق العدالة الجنائية الدولية. حيث يتناول هذا البحث العلاقة بين المحكمة الجنائية الدولية و مجلس الأمن الدولي ، من خلال إستعراض سلطات مجلس الأمن في هذه العلاقة و تحليل مدى تأثير هذه السلطات المتعلقة بأداء المحكمة لوظائفها على استقلال المحكمة ، وانعكاساته على دورها كهيئة قضائية دولية نزيهة و ذات مصداقية. يسعى البحث إلى الكشف عن مدى الحاجة إلى إصلاحات تعالج وتتعامل مع أي إش و مجلس الأمن من أجل تحقيق والحفاظ على الشعور بالمساواة والإنصاف داخل المجتمع الدولي تجاه عمل المحكمة ، وهو جزء لا يتجزأ من كفاءة ولايتها القضائية وحتى وجودها كمؤسسة قضائية دولية. Abstract: The International Criminal Court is widely regarded as a major achievement in the field of public international law for being the first permanent international judicial institution to deal with the most serious international crimes under the concept of individual responsibility. However, as a judicial institution, it is integral for the Court to maintain independence from the influence of other bodies to preserve its competence, legitimacy, and credibility of its decisions. In this regard, the relationship between the ICC and the Security Council has always been the subject of controversy. The research problem deals with the debate surrounding the relationship between the Security Council and the ICC, and what is seen by some as a negative impact affecting the Court’s role. The study reviews the powers of the Security Council in this relationship and analyzes the impact of such powers on the Court's performance and impartiality as an international judicial body. The study seeks to reveal the extent of the need for reforms that address the problematic issues arising from such relationship, which are of great importance to the efficiency of the Court’s jurisdiction and even to its existence as an international judicial institution.
