المواءمة التشريعية الوطنية لنظام روما الأساسي The Compatibility Of The Domestic Law Regarding To The International Criminal Court Statute

Résumé: أكد النظام الاساسي للمحكمة الجنائية الدولية على ضرورة قيام الدول الاطراف باتخاذ كل ما يلزم من اجراءات في تشريعاتها الوطنية، لكفالة كل صور التعاون بينهما، ويكون ذلك بإدخال تعديلات على تشريعاتها الداخلية لكي تتواءم من الناحية الموضوعية مع نظام روما الأساسي. ولأن نظام روما هو اتفاق دولي له آثاره القانونية ، فإن المواءمة التشريعية الوطنية ، أصبحت التزاما دوليا لجميع الدول التي صادقت على الاتفاقية ، واستمد هذا الالتزام أساسه من أحكام النظام نفسه ، ولتجسيد هذا الالتزام تختلف التشريعات الوطنية في انتهاج أحد الأسلوبين الإحالة أو الإدماج The Statute of the International Criminal Court emphasized the need for States parties to take legislative measures which would confer all forms of cooperation with the said Court, and in that sense the States Parties would undertake the necessary domestic legislative changes, stickiness of the substantive rules with the Rome Statute. Since the Rome statute is an international convention with legal implications, all member States to this convention are compelled to harmonize their national legislations with the said statute from which derives this obligation. In order to put this obligation into force, national legislations use two distinct methods: integration or referral.
