معوقات الصيرفة الإسلامية وعوامل نجاحها

Résumé: الملخص: لقد ظهرت المصارف الاسلامية في العقود الأخيرة، وشهدت تطورا ونموا ملحوظا، حيث بلغت ما يزيد على 500 بنك إسلامي حول العالم، تقدم أكثر من 15 صيغة تمويلية إسلامية، ويتناول هذا البحث أهم المشاكل والتحديات التي تواجه المصارف الإسلامية بشكل عام و التي منها حداثة التجربة، وعدم وجود سوق مالية إسلامية، وغياب الشفافية المالية، واقتصارها على صيغة المرابحة فقط، وغياب الحماية القانونية والنظام التشريعي. كما يتناول سبل تطوير العمل المصرفي الإسلامي والتي منها الالتزام بالضوابط الشرعية، وتفعيل الرقابة الشرعية والتدرج في التطبيق من أجل التحول إلى نظام مصرفي إسلامي، وتأهيل الموارد البشريةـ Abstract: The Islamic banks have appeared in the recent period and witnessed a remarkable development and growth. Over 500 Islamic banks worldwide This research deals with the most important problems and challenges facing Islamic banks in general, including, including the novelty of the experience,the absence of an Islamic financial market,the absence of financial transparency and its limitation to the form of murabaha only,the absence of legal protection and the legislative system and its subjection to the bank’s guardianship the central bank also deals with ways to develop banking work in,including adherence to sharia controls, activating sharia supervision and gradual application in order to transform into an Islamic banking system and rehabilitate human resources.
