العقد الذكي ودوره في تكريس الثقة في العلاقات التعاقدية

Résumé: ملخص: لقد أدى صعود تقنية Blockchain إلى ظهور ما يسمى بالعقد الذكي، حيث سمح لهذه الأخيرة باستغلال إمكاناته الكاملة، فيمكن لأي طرف ما إنشاء معاملاته تلقائيًا وبرمجة النتائج والآثار المحتملة التي تنشأ أثناء العلاقة التعاقدية مسبقًا. كما يمكن أن يضمن العقد الذكي أن العقد القانوني سيتم تنفيذه بشكل صحيح وتلقائي أو أن الدفعة المقدمة سيتم استردادها - كليًا أو جزئيًا - في حالة عدم الأداء أو الأداء غير الكامل للعقد. ونتيجة لذلك، فهو يساهم بشكل إيجابي في استعادة مناخ الثقة بين أطراف العلاقة التعاقدية، خاصة في ظل عدم تدخل لأي وسيط بشري. Abstract The rise of Blockchain technology has given rise to the so-called smart contract, as it has allowed the latter to exploit its full potential. Any party can create its transactions automatically and pre-program the potential outcomes and impacts that arise during the contractual relationship. The smart contract can also guarantee that the legal contract will be executed correctly and automatically or that the down payment will be recovered - in whole or in part - in the event of non-performance or incomplete performance of the contract. As a result, it contributes positively to restoring the climate of trust between the parties to the contractual relationship, especially in light of the absence of any human intermediary interference.
