المبادئ والضمانات في ظل قانون الاستثمار الجديد رقم 22-18 من التكريس إلى التعزيز Principles And Guarantees Under The New Investment Law No 22-18 From Dedication To Promotion

Résumé: أصدر المشرع الجزائري قانون الاستثمار الجديد رقم 22-18 على أنقاض القوانين السابقة التي لم تستطع جلب الاستثمارات لاسيما الأجنبية منها، حيث أرسى هذا القانون عدة مبادئ وضمانات لتشجيع الاستثمار وجذب رؤوس الأموال الأجنبية لخدمة الاقتصاد الوطني، وتوفير بيئة للاستثمار في الجزائر، وتتمثل في مبدأ الشفافية عن طريق الرقمنة، والمساواة بين المستثمرين، ومبدأ حرية الاستثمار، وضمان الثبات التشريعي، وضمان تحويل رؤوس الأموال الأجنبية، وضمان عدم التسخير الإداري أو نزع ملكية المشاريع المنجزة إلا وفقا للقانون. كما أنه من أجل توفير حماية أكبر للمستثمرين فقد عزز دور القضاء في معالجة ملفات الاستثمار الوطني، أو عن الطرق البديلة كالمصالحة والوساطة والتحكيم متى وجدت اتفاقيات مبرمة، أو اتفاق خاص، واستحداث لجنة وطنية عليا للطعن توضع لدى رئاسة الجمهورية. Abstract: The Algerian legislator issued the new investment law N˚ 22/18 on the ruins of previous laws that could not attract investments, especially foreign ones, as this law established several principles and guarantees to encourage investment and attract foreign capital to serve the national economy, and provide an environment for investment in algeria, which is represented in the principle of transparency through digitization, equality between investors, the principle of investment freedom, ensuring legislative stability, ensuring the transfer of foreign capital, and ensuring that administrative exploitation or expropriation of completed projects is not carried out except in accordance with the law . In addition, in order to provide protection for the largest investors, it has strengthened the role of the judiciary in dealing with national investment files, or in alternative ways such as reconciliation, mediation and arbitration when there are agreements concluded, or a special agreement, and the creation of a higher national appeal committee to be placed with the presidency of the republic.
