الإطار القانوني الناظم للمحكمة الدستورية في الجزائر (التشكيلة والصلاحيات)

Résumé: مسايرة للمتغيرات الدولية عمل المؤسس الدستوري على ضوء التعديل الدستوري لسنة 2020 إلى إستحداث مؤسسة دستورية جديدة تدعى المحكمة الدستورية تعنى بضمان إحترام الدستور وضبط سير المؤسسات الدستورية ونشاط السلطات العمومية وتسعى إلى تفعيل الرقابة على دستورية القوانين، بحيث رصد لها المؤسس الدستوري نظام قانوني جديد تم من خلاله إعادة النظر في إطارها العضوي (شروط العضوية وضمانات إستقلالها)، وكذا إعادة النظر في إطارها الوظيفي ( تعديل بعض الصلاحيات التي كانت مرصودة للمجلس الدستوري سابقا وإضافة صلاحيات جديدة). The aim of this studies,is to highlight the role of the work of the constitutional legislator in the light of the constitutional amendment of 2020 by creating a new constitutional institution called the Constitutional Court . This new institution is concerned with ensuring respect for the constitution and controlling the functioning of constitutional institutions and the activity of the public authorities by considering its organic framework (conditions of membership and guarantees of its independence), as well as reconsidering its functional framework i.e. modifying some tasks previously attributed to the Constitutional Council and adding new attributions.
