الإطار القانوني للمحكمة الدستورية في الجزائر ( المفهوم والتشكيلة والاختصاصات )

Résumé: ملخص: عوضت المحكمة الدستورية بصفة رسمية المجلس الدستوري من خلال الدستور الصادر في الفاتح من نوفمبر 2020 كأعلى هيئة تشرف على مدى مراقبة دستورية القوانين، وعلى رأسها الدستور. واستنادا إلى نصوص دستور 2020 فإن المحكمة الدستورية ستحتفظ بكامل صلاحيات المجلس الدستوري، من قبيل السهر على ضبط المؤسسات ونشاط السلطات العمومية وصلاحيات أخرى. لذلك فإنه يلزم الحفاظ على هذه المحكمة وعلى اختصاصاتها والعمل على تنفيذ أحكامها، وذلك قصد ضمان حقوق الأفراد وحرياتهم وإعلاء للشرعية الدستورية. : Abstract The Constitutional Court have formally replaced the Constitutional Council through a constitution issued on November 1st, 2020 as the highest body that oversees the extent to which laws are constitutionally monitored, especially the Constitution. And based on the provisions of the 2020’s constitution, the Constitutional Court retains the full powers of the Constitutional Council, in order to ensure the control of institutions, their public activities and other powers. Therefore, it is necessary to preserve this court and its competencies, and work to implement its .provisions. This is to ensure the rights and freedoms of individuals and to uphold constitutional legitimacy
