كفالة حقوق مجهولي النسب في القانون الجزائري - ( في إطار الملتقى الدولي الموسوم ب: الأطر الحمائية للأسرة ودورها في استقرار المجتمع ) -

Résumé: ملخص: اهتم القانون الجزائري بحقوق الطفل مجهول النسب أسوة بأحكام الشريعة الإسلامية والاتفاقيات الدولية، باعتباره مخلوق بشري ضعيف له ظروف خاصة وحقوق إنسانية أساسية يجب احترامها والتكفل بها، من أجل إدماجه في المجتمع وحمايته من كل أنواع العنف والاستغلال. ولقد سعت الجزائر إلى حماية هذه الفئة الضعيفة في منظومتها القانونية قصد توفير الرعاية البديلة لهم عن طريق نظام الكفالة كبديل ملائم للتبني المحرم شرعا حتى يضمن حماية الأنساب وعدم اختلاطها، وعن طريقها يمكن منح اللقب العائلي للطفل المكفول المجهول النسب طبقا للمرسوم التنفيذي 20- 223 المتعلق بتغيير اللقب. Abstract: Algerian law is concerned with the rights of children of unknown descent,in line with the provisions of Islamic law and international conventions, as a weak human creature with special conditions and fundamental human rights that must be respected and guaranteed, in order to integrate them into society and protect them from all kinds of violence and exploitation. Algeria has endeavoured to protect this vulnerable group in its legal system in order to provide them with alternative care through the foster care system as an appropriate alternative to legally prohibited adoption so as to ensure the protection of genealogy and non-intermingling, through which the family title of the foster child of unknown descent can be granted in accordance with the 20- 223 Executive Decree on the Change of Surname.
