إشكالية حماية الأسرة في ظل التجسيد القانوني لمبدأ تمكين المراة في الاتفاقيات الدولية والقانون الجزائري ( في إطار الملتقى الدولي الأطر الحمائية وللأسرة ودورها في استقرار المجتمع)

Résumé: تثير المداخلة إشكالية حماية الأسرة في ظل التجسيد القانوني لمبدأ تمكين المرأة في القانون الجزائري والاتفاقيات الدولية، فتنفيذ الدولة الجزائرية لالتزاماتها الدولية جعلها تتبنى المبدأ في قوانينها الداخلية لتكييف هذه القوانين مع ما انظمت ووقعت عليه من اتفاقيات دولية تحمي المرأة والأسرة على وجه الخصوص، وتبني المشرع الجزائري لهذا المبدأ في مجموعة من النصوص القانونية بدء بالدستور يطرح إشكالية كيفية تعامل القانون مع هذا المبدأ عند إدماجه في المنظومة القانونية الجزائرية، ومدى التوفيق بين حفظ حقوق المرأة وحماية استقرار الأسرة من جهة وتنفيذ الالتزامات الدولية من جهة أخرى The intervention raises a problem on the protection of the family in light of the legal reflection of the principle of women’s enabling in Algerian law and international conventions. The Algerian State’s implementation of its international obligations had made it adopt the principle in its domestic laws to adapt those laws to the international conventions it had joined and signed, which protect women and the family in particular. The adoption of this principle by the Algerian legislature in a series of legal texts, starting with the Constitution raises the problem of how the law dealt with this principle when it was incorporated into the Algerian legal system and to what extent it reconciled the preservation of women’s rights and the protection of family stability on the one hand with the implementation of international obligations on the other.
