أثر الظروف الطارئة على تطبيق غرامة التأخير في مجال الصفقات العمومية

Résumé: يهدف هذا البحث إلى دراسة أثر الظروف الطارئة على تطبيق غرامة التأخير ضد المتعامل المتعاقد في مجال الصفقات العمومية ، إذ يعتقد هذا الأخير أن هذه النظرية سبب لإعفائه من الغرامة التأخيرية حالة توقفه عن تنفيذ الصفقة العمومية التي أبرمها مع الإدارة المتعاقدة ، إلا أن نظرية الظروف الطارئة وفي كل الحالات لن تعفيه من الخضوع لجزاء غرامة التأخير حالة توقفه عن الإستمرار في تنفيذه إلتزاماته التعاقدية. This research aims to study the effect of Unpredictable circumstances on the application of the delay penalty against the contractor in the field of public procurement, the latter considering that this theory is a reason to exempt him from the delay penalty if he ceases to perform the public procurement which he has concluded with the contracting administration, however the theory of Unpredictable circumstances in any case will not exempt him from the delay penalty if he ceases to fulfill his contractual obligations.
