أثر التكريس الدستوري لآلية الدفع بعدم الدستورية على نظام الرقابة على دستورية القوانين في الجزائر

Résumé: تهدف هذه الدراسة إلى تبيان أهمية الأثر الذي أحدثه إدراج آلية الدفع بعدم الدستورية ضمن التعديل الدستوري لسنة 2016 ومن بعده التعديل الدستوري لسنة 2020 على نظام الرقابة على دستورية القوانين. ومنه أثيرت الاشكالية الآتية: كيف أثر التكريس الدستوري لآلية الدفع بعدم الدستورية على هذا الأخير؟ وقد توصلت هذه الدراسة للنتائج التالية: تأكيد أثر هذا التكريس على مستوى أسلوب تحريك الرقابة ومجالها: بتوسيع آلية الإخطار إلى أطراف الدعوى وإقحام القضاء في مجال الرقابة بتطبيق نظام التصفية.و بالمساهمة في تجديدها: بإضفاء خصوصية على آجال وإجراءات الفصل في الدفع، إعمال مبدأ الوجاهية وتوسيع صلاحيات المجلس الدستوري (المحكمة الدستورية)، ومنه التحول مستقبلا نحو عدالة دستورية فعلية تمكن من تعميق النقاش الدستوري، وفي ذلك ضمانة أكبر لحماية الحقوق والحريات وتحقيق دولة الحق و القانون. Cette étude vise à démontrer l'importance de l’impact de L'intégration du mécanisme de recours en inconstitutionnalité dans la révision constitutionnelle de 2016 et après celle de 2020, sur le système de contrôle de la constitutionnalité des lois. De cela la problématique suivante a été soulevé: quel est l’impact de cette intégration sur ce système ? L’étude a conclue que ce système a changé au niveau du mode d’utilisation du contrôle et son domaine: en élargissant le mécanisme de saisine aux parties de l’instance et l'implication du pouvoir judiciaire dans le domaine du contrôle, en appliquant le système de liquidation ; et par la contribution à son renouvellement en ajoutant une spécificité aux délais et procédures pour la résolution du recours, en appliquant le principe du contradictoire et en élargissant les attributions du Conseil constitutionnel( la cour constitutionnelle). Cela contribuera à une transition future vers une véritable justice constitutionnelle qui permettra d'approfondir le débat constitutionnel, et dans cela une plus grande garantie des droits et libertés et la concrétisation de l'Etat de droit. This study aims to demonstrate the importance of the impact of The integration of the mechanism of exception of unconstitutionality claim in the constitutional revision of 2016 and after that of 2020, on the system of review of the constitutionality of laws. Thus the following problematic is raised : how did this integration impact the system ? This study has concluded that this system has been changed both in terms of the way of use of control and its fields: by the extension of the seisin mechanism to the parties of the instance and the involvement of the judiciary in the area of control by applying the liquidation system; and its contribution to its renewal: by adding specificity to the deadlines and procedures for the resolution of cases by applying the principle of adversarial proceedings and expanding the powers of the Constitutional Council (the constitutionnal court). This will contribute to a future transition towards genuine constitutional justice, which will deepen the constitutional debate, thus permiting a greater guarentee of rights and freedoms and the implementation of the rule of law.
