استحداث المحكمة الدستورية في الجزائر

Résumé: المؤسس الدستوري الجزائري ساير التطور الحاصل على أساليب الرقابة على دستورية القوانين خاصة بعد إقراره لآلية الدفع بعدم الدستورية وذلك من خلال تبنيه نمطا جديدا من الرقابة على دستورية القوانين،حيث استحدث في التعديل الدستوري لسنة 2020 مؤسسة دستورية رقابية جديدة وهي المحكمة الدستورية وهذا مكان المجلس الدستوري،تكلف بضمان احترام الدستور وضبط سير المؤسسات ونشاط السلطات العمومية و تسعى إلى تفعيل الرقابة على دستورية القوانين،فتم الاحتفاظ فيها ببعض مقومات المجلس الدستوري من جهة ومن جهة ثانية إحداث تعديلات فيم يخص التشكيلة وتوسيع الصلاحيات خاصة ما تعلق منها بمجالات الإخطار وضبط أكثر لصلاحيات المحكمة الدستورية في كل المجالات،وهذا كله من أجل تعزيز فعالية الرقابة على دستورية القوانين في الجزائر وحماية الحقوق والحريات المكفولة دستوريا Algerian constitutional founder Sayers Sawyer has developed the methods of monitoring the constitutionality of laws, especially after he approved the mechanism for the defense of atonality by adopting a new pattern of monitoring the constitutionality of laws.
