توثيق العقد وحجيته Notarization Of Contract And Its Authority

Résumé: يعتبر العقد التوثيقي من أكثر المجالات ارتباطا بمبدأ الأمن القانوني، حيث أصبح ضرورة اجتماعية ملحة وأحد مرتكزات دولة القانون والمؤسسات. فالتنمية الاقتصادية تتوقف على توفر الأمن القانوني، كما أصبح هذا المفهوم آلية لتقييم جودة النصوص القانونية. ويقوم الأمن القانوني، فأصبح مبدأ الأمن القانوني وما يتفرع عنه من الثقة المشروعة واستقرار المعاملات في صلب الاهتمام، بفضله يوفر للأفراد المتعاقدة الحماية والاستقرار في إطار عقدهما الموثق. وجاء هذا المقال ليسلط الضوء على أهمية العقد التوثيقي وضرورته في توفير الأمن القانوني. The notarial contract is one of most related fields to the principle of legal certainty, since it has become an urgent social necessity and one of the pillars of the rule of law and institutions. Economic development depends on the availability of legal certainty, and this concept has become a mechanism for assessing the quality of legal texts. And legal certainty is established, and the principle of legal certainty and its legitimate trust and the stability of transactions arising from it have become the focus of attention, thanks to which it ensures the protection and stability of contracting personnel within the framework of their authenticated contract. This article came to highlight the importance of notarized contract and its role in protecting legal security.
