Résumé: الملخص: مع ظهور العالم الافتراضي أصبح ضرورة حتمية الانتقال إلى التجارة الإلكترونية لمسايرة التطورات التكنولوجية و الاستفادة من مزاياها ، كالسرعة في إبرام العقود و عدم الوجود المادي للمتعاقدين للحصول على المنتج أو الخدمة، غير أن عقد البيع الإلكتروني لا يخلو من المخاطر المهددة للمستهلك الإلكتروني سواء المتعلقة بالمبيع أو بالمهني ، إلا أن المشرع كرس له آليات قانونية لحمايته . و قد ارتأينا في هذه الدراسة أن نتطرق إلى آلية الضمان القانوني التي تمنح للمستهلك التعويض عن الضرر الذي لحقه إما لوجود عيب في المنتوج ، أو لإخلال المُنتج بإحدى التزاماته التعاقدية أو غير التعاقدية في مرحلة إعلام المستهلك إلكترونيا قبل مرحلة إبرام العقد ، و دراسة مدى تحقيق هذه الضمانة للثقة و الآمان في السوق الإلكترونية ، و هو ما يحتاجه المستهلك الإلكتروني لتلبية حاجياته الشخصية Abstract: With the advent of the Virtual world, It has become imperative to move to E-commerce to keep pace with technological developments and benefit from its advantages, Such as the speed in concluding contracts and the physical absence of the contractors to obtain the product or service , However, the legislator has established legal mechanisms for his protection. In this study, We decided to address the legal guarantee mechanism that gives the consumer compensation for the damage he has suffered Either because of a defect in the product, or because the producer breached one of his contractual or non-contractual obligations at the electronic consumer stage before the contract conclusion stage, And a study of the extent to which this guarantee achieves trust and safety in the electronic market, which is what the electronic consumer needs to meet his personal needs.
