الضمانات المقررة لحماية الطفل أثناء التحقيق والمحاكمة في التشريع الجزائري The Guarantees Established For The Protection Of The Child During The Investigation And Trial In The Algerian Legislation

Résumé: لقد حظي الطفل باهتمام كبير من طرف جميع الشرائع السماوية والقوانين الوضعية كونه يعتبر حجر الأساس الذي يبنى عليه المجتمع كما أنه الحلقة الأضعف والمعرضة أكثر لإمكانية انحراف سلوكا ته من جهة، والأكثر تأثرا بالانتهاكات في مجال حقوق الإنسان من جهة أخرى. لذا نجد معظم التشريعات الدولية و المحلية، ومنها التشريع الجزائري أولت عناية خاصة للطفل منتهجة في سياستها الجنائية أهم القواعد والإجراءات التي تكفل ضمان معاملتهم على أساس فئتهم ألعمرية سواء أثناء التحقيق أو المحاكمة من أجل ضمان حقوقه وحمايته. Abstract All heavenly religions and man-made laws have gave a special attention to the child, as he is regarded as the cornerstone upon which society is built, as he is the weakest link and most vulnerable to the possibility of deviation in his behavior on the one hand, and the most affected by human rights violations on the other. As a result, we find that most international and local legislation, including Algerian legislation, has given special attention to children, employing the most important rules and procedures in its criminal policy to ensure that children are treated according to their age group, whether during investigation or trial, in order to ensure their rights and protection.
