'معهود العرب اللّساني' عند الشّاطبي قراءة تجديدية في مناهج تأويل الخطاب الشرعي 'the Linguistic Arab Tradition' By Al-shatibi - A Renewed Reading In The Curricula Of Interpretation Of Religious Discourse

Résumé: ملخص : إن اعتناء الأصوليين بالخطاب الشرعي فهما واستنباطا، واحترازهم وتحفظهم في تفسيره وتأويله اضطرّهم إلى الاجتهاد المستمر والمتجدد في تنقيح المنهج الأصولي المعتمد لقراءة النصوص الشرعية، ومراجعة أدواته وآلياته، وتهذيب أصوله وقواعده، وكان من أبرز محاولات التجديد تلك، تقريراتُ الشاطبي لما اصطلح عليه بــــ 'معهود العرب الأميّين'، وذلك ما يشمل أعراف العرب وعوائدها في التعبير عن قصودها، ووجوه مخاطباتها، وأساليبها في الحمل والفهم والتلقّي. تتمحور إشكالية البحث في تقرير حقيقة 'معهود العرب الّلساني' ومدى تأثيره في تجديد مناهج الاستدلال الأصولي، وقد اعتمدت الدراسة على المنهج التحليلي الوصفي، وأفضت إلى ضرورة الاحتكام إلى ذلك المعهود والإحالة عليه في عملية تفسير النصوص الشرعية، وإلا كانت القراءة خروجا عن المراد، ومجانبة للمقصود. Abstract: The interest of the scholars of the principles of jurisprudence to the religious text in terms of understanding and deducing from it, forced them to constantly strive to renew the scientific method in force to read religious texts, one of the most prominent attempts at renewal was the idea of Shatbi in research the 'Arab linguistic tradition', by which we mean the customs of the Arabs and their customs in expressing their intention, and their methods of understanding and receiving discourse. The problematic of the research is to determine the truth of the 'Arab linguistic tradition' and its relationship to the renewal of inference methodology, and this study has relied on the descriptive analytical approach, and led to the need to resort to that customary and refer to it in the process of interpreting religious texts..
