ضوابط الانتفاع بالمباح وأثره في الاقتصاد الإسلامي عقد الرهن نموذجا

Résumé: يعالج موضوع الدراسة أحد المواضيع المهمة في الشريعة الاسلامية وكذا الاقتصاد الاسلامي باعتباره يتناول البحث ضوابط تقييد الانتفاع بالمباح وأثره على الاقتصاد الاسلامي، نظرا لكون موضوع تقييد المباح واسعا ومتجددا، فكان لابد من معرفة ضوابط تقييده وبيان أثره على الاقتصاد الاسلامي، وهنا تظهر عظمة وكمال الشريعة الإسلامية في تناولها لجوانب الحياة المختلفة، ورعاية مصالحهم ومسايرتها وملائمتها للظروف والحوادث المتجددة، وهذا انطلاقا من الإشكال الآتي: ما ضوابط الانتفاع بالمباح؟ وكيف يأثر على الاقتصاد الاسلامي؟ وقد اتبعنا لدراسة هذا الموضوع كلا من المنهج الوصفي والتحليلي لتوضيح ضوابط تقييد الانتفاع بالمباح، وفي نهاية هذا البحث توصلنا إلى عدة نتائج أهمها: إن المصلحة العامة هي المحافظة على مقصود الشرع بدفع المفاسد عن الخلق. وقد تم طرح بعض التوصيات منها: السعي إلى عقد مؤتمرات عالمية لتعريف بالشريعة الغراء وبيان سماحتها ومحاسنها. The subject of the study deals with one of the important topics in Islamic law as well as the Islamic economy as the research deals with the controls of restricting the use of permissibility and its impact on the Islamic economy، given that the subject of restricting permissibility is broad and renewed، so it was necessary to know the controls of restricting it and indicating its impact on the Islamic economy، and here the greatness and perfection of Islamic law appears in dealing with various aspects of life، and taking care of their interests and keeping pace with and suitability for renewable conditions and accidents، and this is based on the following problem: What are the controls for the use of permissibility? How does it affect the Islamic economy? We have followed to study this topic both the inductive، descriptive and analytical approach to clarify the controls for restricting the use of permissible، and at the end of this research we reached several results، the most important of which are: The public interest is to preserve the intention of Sharia to pay the evils of creation. Some recommendations were put forward، including: Seeking to hold international conferences to introduce Sharia and explain its tolerance and merits.
