الطابع الدولي لمصادر قانون الملكية الصناعية The International Character Of The Sources Of Industrial Property

Résumé: ظهرت قواعد قانون الملكية الصناعية في بدايتها كتشريعات تحمي حقوق أصحابها داخل إقليم الدولة، ومع تدويل وانتشار التجارة تم تنسيق هذه القواعد عبر المعاهدات والاتفاقيات الدولية التي وضعت الأسس القانونية الدولية لحماية حقوق الملكية الصناعية. ولمواكبة مبادئ الاقتصاد الليبرالي وجدت الجزائر نفسها مجبرة على إعادة النّظر في تشريعات الملكية الصناعية مما يسمح لها بالاندماج في النظام الاقتصادي الدولي الجديد، وهو ما أضفى على مصادر قانون الملكية الصناعية طابعا دوليا يمس بسيادة الدولة من حيث حريتها في سن القواعد القانونية، إلّا أنّه في نفس الوقت يضمن حماية حقوق الملكيّة الصناعيّة لرعايا الدولة ورعايا باقي الدول ليس في بلدهم وحسب ولكن على المستوى الدولي. Abstract: The rules of industrial property law appeared in their infancy as legislation that protects the rights of their owners in the country’s territory. However, with the internationalization and spread of trade, legal rules have been harmonized through the international treaties and agreements that have laid the international legal foundations for the protection of industrial property rights to keep up with the principles of the liberal economy. Which gave the sources of industrial property law an international character that affects the sovereignty of the state in terms of its freedom to enact legal rules, but at the same time guarantees the protection of the industrial property rights of state nationals and nationals of other countries, not only in their own country, but at the international level.
