التزام البنك المصدر بفحص المستندات في الاعتماد المستندي

Résumé: يعتبر الاعتماد المستندي أهم تقنية دولية تستعمل في تسوية المبادلات التجارية الدولية لما توفره من ثقة وائتمان لأطرافه. وأهم ما يميّز هذه التقنية استقلال العلاقات الناشئة عنه رغم أن كل علاقة سبب في نشأة الأخرى. يهدف هذا البحث لدراسة أهم التزام في الاعتماد المستندي هو التزام البنك بفحص المستندات المقدمة إليه من المستفيد والتأكّد من مطابقتها لشروط الاعتماد كونها القلب النابض للاعتماد لذا توجب على البنك فحصها فحصا دقيقا، لأن قبول مستندات غير مطابقة لتعليمات عميله يرتب مسؤوليته أمام عميله ، لكن المبدأ الذي تقوم عليه عملية الفحص هو اقتصار البنك على فحص ظاهر المستندات دون التحري عن حقيقة البضاعة وهو ما يشجّع البنك التعامل بهذه التقنية. Documentary credit is the most widely international technique used in the settlement of international trade, because of its trust and credit to its parties. The most important feature of documentary credit is the independence of the relationships that flow from it, although each relationship is the source of the other’s. The most important commitment in the documentary credit is the obligation of the issuing bank to examine the documents presented by the beneficiary and to make sure that it complies with the terms of documentary credit. Therefore the bank must carefully examine them, because the acceptance of documents that do not comply with the instructions of its customer incurs responsibility towards his client and the latter may refuse to receive these nonconformity documents or request compensation.
