خصوصية الضمان في مجال الاعتماد المستندي

Résumé: بالرغم من أهمية الاعتماد المستندي في مجال التجارة الخارجية، لما يقدمه من دعم للعميل الآمر من جهة، وتسهيلات للبائع المستفيد في الحصول على ثمن البضاعة من جهة أخرى، إلا أن البنك مانح الاعتماد يكون دائما حذرا عندما يتعلق الأمر بالالتزام الكامل ووضع الثقة التامة في العميل، فيطلب إزاء ذلك ضمانات أخرى قد تكون في شكل غطاء للاعتماد المستندي إضافة إلى حقه في الرهن الحيازي على البضاعة بمسك المستندات التي تمثلها إلى حين دفع العميل المشتري لثمنها. عند ذلك يمكن للبنك إعطاء ضمانات لهذا العميل بالدفع للبائع بدلا عنه وبالتالي تسهيل العملية التجارية وإتمام الصفقة في أسرع وقت ممكن. وهنا تكمن خصوصية الاعتماد المستندي كضمان، حيث يتعامل البنك فاتح الاعتماد بهذه الاداة مع الكثير من الحيطة والحذر، وبالتالي قد ينقص هذا من قيمتها كأداة للضمان. : Despite the importance of the documentary credit support for the ordering customer in the foreign trade, on one side , and the facilities for the beneficiary seller on the other side, the opening credit bank has always been careful about the full commitment, and the confidence in the customer; for that, it required additional guarantees in a documentary credit coverage form .
