تسيير و استغلال الأراضي الوقفية العامة المخصصة للفلاحة عن طريق الايجار Management And Exploitation Of Wakf Lands Public Allocated For Agriculture By Lease

Résumé: ملخص : يعتبر الايجار أحسن أسلوب لتسيير و استغلال الأملاك العقارية الوقفية العامة المخصصة للفلاحة، يتم ايجارها وفقا لأحكام المرسوم التنفيذي رقم 14-70 المؤرخ في 20 فيفري 2014 ،إما بصيغة المزاد العلني أو التراضي بالنسبة للأملاك الوقفية المعلومة، أو بصيغة الايجار الذي يخضع الى نظام خاص بالنسبة للأملاك الوقفية المسترجعة من الدولة . لتحديد الجانب القانوني لتسيير و استغلال هذه الأملاك ، كان لابد من معرفة الأحكام القانونية المنظمة لآلية الايجار بمختلف صيغها ، أين حاول المشرع رغم اختلاف شروط وكيفيات منح ايجارها، الى تحقيق نوع من الموازنة بين حقوق و التزامات المستأجرين المنتفعين من الأراضي الوقفية العامة المخصصة للفلاحة، و بين فرض الحماية القانونية على أصل الملك الوقفي و المحافظة على وجهته الفلاحية ، إلا أن العمل بأحكام المرسوم التنفيذي رقم 14-70 يجب أن يتلاءم تنفيذها مع القواعد القانونية و الواقع حتى تساهم في تنمية الأراضي الوقفية المخصصة للفلاحة . Abstract: Lease is considered as the best method for the management and the exploitation of public Wakf property for agriculture, which are lease in accordance with the provisions of the Executive Decree 14-70 of 20th February 2014, either in the form auction or consent for recognized lands Wakf properties , or in the form of a lease which is subject to a special regulation for lands Wakf retrieved of the state. to determine the legal aspect of the management and the exploitation this property, it was must be to know the legal provisions governing the lease mechanism in different forms. Where he tried to which the law maker tried to make a balance between the rights and obligations of land tenants and the imposition of legal protection of Wakf property, and the preservation of agricultural field ,despite the different conditions and procedures for granting the right to lease . but the work with provisions of the Executive Decree 14-70 their implementation must be adapted to the legal rules and fact with the objective to contribute to the development of Wakf property allocated to agriculture.
