مبدأ معصومية الجسد البشري وعمليات التبرّع بالخلايا والأنسجة البشرية بين الأحياء -دراسة مقارنة- The Principle Of The Inviolability Of The Human Body And The Donation Of Human Cells And Tissues Between Living Persons -a Comparative Study-

Résumé: يشهد العالم تطورا هائلا في المجال الطبي و العلمي حيث برزت تقنيات و وسائل علاجية حديثة أسهمت في إنقاذ العديد من الأرواح، والتي من بينها عملية استئصال و زرع الخلايا و الأنسجة البشرية بين الأحياء، إلا أنّ هذه العمليات أثارت الكثير من الإشكالات لمساسها بمبدأ الحق في سلامة الجسم و الذي يعتبر من أهم الحقوق التي يتمتع بها الفرد، لهذا كانت موضوع جدل فقهي و قانوني انتهى إلى مشروعيتها وذلك باعتبارها استثناء عن مبدأ الحق في سلامة الجسد و وسيلة من وسائل حمايته متى كانت الضرورة العلاجية متوافرة، لذلك هدفت هذه الدراسة إلى النظر في مدى توفير الحماية الجسدية باعتبارها المبدأ في سياق هذه العمليات، واستكشاف نطاق هذه الحماية من خلال المبادئ التي وضعتها التشريعات والقوانين لتحدّ وتقيّد من هذا الاستثناء. The world is witnessing rapid advancements in medical and scientific fields, with the emergence of new treatment techniques and methods that have saved countless lives. One such advancement is the transplantation of human cells and tissues between living individuals. However, these procedures have raised numerous ethical and legal concerns due to their potential infringement on the fundamental right to bodily integrity. Despite these concerns, these procedures have been legalized, with the justification being that they serve as an exception to the rule of bodily integrity and a means of protecting it when medical necessity dictates, This study aims to investigate the extent to which bodily integrity is protected in the context of such procedures and to explore the scope of this protection through the principles established by legislation and laws to define and limit this exception.
