مظاهر استقلالية السلطة الوطنية المستقلة للانتخابات

Résumé: أنشأ المشرع الجزائري بموجب المادة الثانية من القانون العضوي رقم 19-07 المؤرخ في 14 سبتمبر سنة 2019 السلطة الوطنية المستقلة للانتخابات تتمتع بالشخصية المعنوية والاستقلال المالي، تمارس مهامها بدون تحيز، بغرض تجسيد وتعميق الديمقراطية الدستورية وترقية النظام الانتخابي الذي يضمن التداول السلمي على السلطة، إذ منحت لأجل هذا الغرض جميع الصلاحيات التي كانت ممنوحة للإدارة في تنظيم الانتخابات وصلاحيات الهيئة العليا المستقلة لمراقبة الانتخابات في مجال الرقابة على الانتخابات. تضمن المشرع في القانون العضوي المذكور اعلاه النص على العديد من مظاهر استقلالية السلطة الوطنية المستقلة للانتخابات من الناحية العضوية ولاسيما التنوع في التشكيلة ومن الناحية الوظيفية من خلال منحها الاستقلال القانوني والمالي والإداري، حتى تتمكن السلطة من القيام بمهامها على أكمل وجه. The Algerian legislator established, under Article 2 of the Organic Law No. 19-07 of September 14, 2019, the Independent National Electoral Authority, with moral personality and financial independence, that exercises its functions without bias, with the aim of materializing and deepening constitutional democracy and upgrading the electoral system that guarantees the peaceful transfer of power, as For this purpose, it was granted all the powers that were granted to the administration in organizing the elections and the powers of the Independent Supreme Commission for Elections Monitoring in the area of election oversight. And the legislator in Organic Law No. 19-07 included many aspects of the independence of the independent national authority for elections in terms of membership, especially diversity in the composition and in functional terms by granting them legal, financial and administrative independence, so that the authority can carry out its tasks to the fullest.
