Résumé: ضع استحدث التعديل الدستوري 2020 السلطة الوطنية المستقلة للانتخابات التي تعتبر من بين مظاهر الإصلاح في الجانب المتعلق بتجسيد مطالب الشعب الجزائري المنادية بسيادته، واعتباره مصدرا للسلطات، وهذا لا يتأتى إلا عن طريق ممثليه المنتخبين في مختلف المجالس على المستوى المركزي او المحلي، وكما يتأتى أيضا عن طريق صيانة وحماية اختيار الشعب، وعليه وفي هذا السياق تم النص على هذا الجهاز للقيام بهذا الدور المحوري، أي رقابة الانتخابات وصيانة راي الشعب، كما تضمن النص أيضا تمكين هذا الجهاز من طل مظاهر الاستقلال والحياد في أداء الدور المنوط به. و نظرا لما سبق فقد أولى المشرع الدستوري للسلطة الوطنية المستقلة للانتخابات أهمية كبيرة من خلال إفرادها بفصل كامل في التعديل الدستوري 2020 في الفصل الثالث من الباب الرابع المعنون بمؤسسات الرقابة المواد من 200 إلى 203 ،ثم تلاها صدور الأمر 21-01 المتضمن القانون العضوي للانتخابات المؤرخ في 14 مارس 2021 والذي الغي بموجبه القانون العضوي رقم 19- 07 سالف الذكر، و تتجلى استقلالية السلطة الوطنية للانتخابات من خلال تشكيلتها وشروط العضوية بها وصلاحياتها أين تم النص على مظاهر استقلاليتها في التعديل الدستوري من جهة، ومن جهة أخرى تم التأكيد على هذه الاستقلالية من خلال ما جاء في الأمر 21-01 .المتضمن القانون العضوي للانتخابات . The constitutional amendment of 2020 has created the Independent National Authority for Elections, which is considered among the manifestations of reform in the side related to embodying the Algerian people demands for its sovereignty, and considering it a source of powers, and this can only be achieved through their elected representatives in the various councils at the central or local level, and also through maintaining and protecting the people’s choice, so in this context this body was stipulated for playing this pivotal role, which is monitoring elections and preserve the people’s opinion. And it is stipulated the empowerment of this body for all manifestations of the independence and impartiality in palying its role. Regarding to the previous matter the constitutional legislator has maken a great importance to the national authority for elections through singling out it by an entire chapter in the constitutional amendment of 2020 in third chapter from the fourth axis entitled controlling institutions, articles 200 to 203, followed by the order 21-01 containing the organic law for elections dated on march 14, 2021, which canceled the organic law no. 19-07, and the independence of the national election authority is manifested through its formation, its membership conditions and its authorities , where the manifestations of its independence were stipulated in the constitutional amendment on the one hand, and on the other hand this independence was confirmed by what was stated in order 21-01 containing the organic law for elections.
