التنظيم القانوني لقضاء العمل العراقي دراسة وفق قانون العمل العراقي رقم (37) لسنة 2015

Résumé: الملخص: يعد قضاء العمل قضاء متخصص ذي تشكيل خاص، إذ نجد لكل من طرفي العمل ممثل عنهم ضمن تشكيلة المحكمة؛ وذلك لاختلاف طبيعة الدعوى التي يتولى الفصل فيها، إذ تتنوع المصالح والعلاقات وتوازن القوى في الدعوى ذاتها مما يتطلب وجود تشكيلة خاصة تكفل تمثيل الاطراف بشكل عادل وفهم أقرب لظروف العمل التي تحكم هذهِ العلاقات، وتخصص في نوع معين من الدعاوى مما يسرع ويطور امكانيات الهيئة القضائية التي تتولى النظر في هكذا نوع من الدعاوى مما يقودنا الى مبدأ تخصص القضاة الذي ينادي به الكثير في الوقت الحاضر. كما وتمثل الحقوق والالتزامات الواردة في قانون العمل بالنسبة للعامل على صاحب العمل الحد الادنى اللازم لكفالة توازن القوى بين الطرفين الذي وجد القضاء لحمايته ويجوز الارتفاع عن هذا الحد بموجب عقد العمل ومن ثم يصبح صاحب العمل مسؤول عن أي اخلال بالتزاماته امام قضاء العمل الكلمات المفتاحية: التنظيم - القانوني- لقضاء - العمل – العراقي Abstract: The judiciary represents a specialized judiciary with a special formation، where each of the two parties represents a representative within the court's composition. This is because of the different nature of the case in which it is adjudicated. The interests، relationships and balance of power vary in the case itself. Which is the closest to the working conditions governing these relations، and specializes in a particular type of lawsuits، which expedites and develops the possibilities of the judiciary، which deals with this type of litigation، leading us to the principle of specialty judges، which is called for a lot at the present time. The rights and obligations set out in the Labor Code for the worker represent the minimum necessary to ensure the balance of power between the two parties، which the judiciary has found to protect، and may be higher than this limit under the employment contract، and thus the employer is liable for any breach of his obligations before the labor.
