مثاراتُ الغلط في التكييف الفقهي للنوازل المالية المعاصرة Reasons For Error In Jurisprudential Adjustment Of Contemporary Financial Accidents

Résumé: الملخص يتغيَّا هذا البحث كشف اللثام عن الأسباب والعوامل المؤدية إلى الغلط في تكييف النوازل والمستجدات المالية، وتأتي أهميته من أهمية هذه المرحلة المهمة في العملية الاجتهادية؛ إذ يُعَدُّ التكييف الفقهي قوامَ الاجتهاد وملاكَه، وحجر الزاوية في توصيف الوقائع والحوادث وتعيين مناطات الأحكام تمهيدًا للحكم عليها، وهو مورد اجتهادي صعب، يُحتاج فيه إلى روافدَ فطريةٍ وتكوينيةٍ، من فقاهة نفسٍ، وذوقٍ فقهيٍّ، وطول باعٍ في العلوم والمعارف، وإن طبيعة البحث تملي التوسل بالمنهجين الاستقرائي والتحليلي، من خلال استقراء الواقع بأحداثه ونوازله، وتحليلها بالوقوف على أهم النوازل المالية ومكامن الخلل في تكييفها، ومن ثم نقدها والاستدراك عليها، في محاولة لتقييمها، وكشف مواطن الضعف فيها، ويتوقع أن يخلص البحث إلى نتائج عدة، من أهمها: إن التكييف الفقهي تحكمه ضوابط وقواعد خاصة، يؤدي إهمالها أو إهمال شيء منها إلى مزالق وأخطاء شتى، وذلك كأن يكيف المجتهد الواقعة على أصل غير معتبر شرعًا، أو يجافي في تكييفه مبدأ التريث والتأني، وغير ذلك كثير من مثارات الغلط في التكييف، كما أوصى البحث بالاهتمام بدراسة هذا الموضوع، والله ولي التوفيق. Abstract This research seeks to uncover the causes and factors that lead to a mistake in adapting calamities and financial developments, and its importance comes from the importance of this important stage in the discretionary process. As jurisprudential conditioning is the foundation and angel of ijtihad, and the cornerstone in describing facts and accidents and assigning the prerogatives of rulings in preparation for judging them. Using the inductive and analytical approaches, by extrapolating reality with its events and calamities, and analyzing them by identifying the most important financial calamities and deficiencies in adapting them, and then criticizing and correcting them, in an attempt to evaluate them, and uncover weaknesses in them. It is expected that the research will conclude with several results, the most important of which are: Jurisprudential conditioning is governed by special controls and rules, neglecting them or neglecting some of them leads to various pitfalls and errors, such as adapting the diligent located on an origin that is not considered legally, or avoiding in adapting the principle of patience and deliberation, and many other causes of error in conditioning, as the research recommended attention Studying this topic.
