إرجاء مجلس الأمن لاختصاص المحكمة الجنائية الدولية Security Council Postponement Of The Jurisdiction Of The International Criminal Court

Résumé: يتمتع مجلس الأمن بسلطة إرجاء اختصاص المحكمة الجنائية الدولية، إذ لا يجوز للمحكمة أن تبدأ بتحقيق بموجب النظام الأساسي لها، كما يجب أن تتوقف عن هذا التحقيق إذا كانت قد بدأت فيه من قبل، إذا طلب منها من مجلس الأمن ذلك ، لمدة اثنتي عشر شهرا، وذلك بموجب قرار يصدره بموجب الفصل السابع من ميثاق الأمم المتحدة، ويجوز للمجلس تجديد الطلب بالشروط ذاتها.، ولقد مارس المجلس هذا الإرجاء من خلال القرار ين رقم 1422، و1497 الذين أصدرهما، ويعد هذا الإجراء الذي يمارسه مجلس الأمن تدخلا في اختصاص المحكمة الجنائية الدولية، من طرف هيئة سياسية، مما يقتضي تعديل النظام الأساسي لإلغائه، حتى تمارس المحكمة اختصاصها القضائي بكل استقلالية. The Security Council has the power to defer the jurisdiction of the International Criminal Court, as the Court may not begin the investigation under its Statute, for a period of twelve months, if requested by the Security Council, by a decision issued under Seventh chapter, and the Council may renew the request under the same conditions. The Council has exercised the power of deferment through Resolutions number 1422 and 1497, which it issued. This measure by the Security Council is interference in the jurisdiction of the International Criminal Court, by a political body, which requires amending the statute to repeal it, so that the Court exercises its jurisdiction away from any pressures.
