صيغ التمويل النقدي طبقا لضوابط الصيرفة الإسلامية بالجزائر– دراسة على ضوء النظام 20/02 المحدد للعمليات البنكية المتعلقة بالصيرفة الإسلامية وقواعد ممارستها من طرف البنوك و المؤسسات المالية –

Résumé: تهدف هذه الدراسة إلى تقصي الصيغ التمويلية، والتي تمثل بدائل تقدمها الصيرفة الإسلامية في الجزائر لعملائها الباحثين عن التمويل النقدي تبعا للأحكام التي جاء بها النظام 20/02 المحدد للعمليات البنكية المتعلقة بالصيرفة الإسلامية وقواعد ممارستها من طرف البنوك والمؤسسات المالية؛ من منطلق أن الكثير من هؤلاء يتطلعون إلى معاملات تتوافق وأحكام الشريعة الإسلامية، فضلا عن الأهمية الإقتصادية لهذا النوع من التمويل لهؤلاء، وعلى إعتبار أن تجربة الصيرفة الإسلامية حديثة عهد بالتطبيق في الجزائر، خلصت هذه الدراسة إلى أن الصيغ التمويلية الإسلامية والتي يمكن من خلالها الحصول على تمويل نقدي تتمثل في كل من صيغ: المشاركة والمضاربة والسلم، كما أن صدور النظام البنكي20/02 قد سن أحكاما متخصصة لتنظيم العقود التمويلية وفق الصيغ الإسلامية مما أضفى مزيدا من ثقة العملاء في عمليات الصيرفة الإسلامية. This study aims to investigate the financing formulas that represent alternatives offered by Islamic banking in Algeria to its clients looking for cash financing according to the provisions of the 20/02 system that defines banking operations related to Islamic banking and the rules for its practice by banks and financial institutions; On the grounds that many of them are looking forward to transactions that comply with the provisions of Islamic Sharia, as well as the economic importance of this type of financing for these.Considering that the experience of Islamic banking is recent in application in Algeria, this study concluded that the Islamic financing formulas through which it is possible to obtain cash financing are represented in each of the forms: participation, speculation andpeace, and the issuance of the banking system 02/20 has enacted specialized provisions To organize financing contracts according to Islamic formulas, which added more confidence to customers in Islamic banking operations.
