القوة الملزمة للعقد و جائحة كورونا كوفيد 19

Résumé: الملخص : يعتبر العقد شريعة المتعاقدين فلا يجوز نقضه أو تعديله إلا باتفاق أطرافه، لكن قد تحدث ظروف استثنائية تجعل تنفيذ الالتزام مرهقا ان لم نقل مستحيلا لظرف طارئ أو قوة قاهرة. وبتناولنا موضوع القوة الملزمة للعقد وجائحة كورونا كوفيد19، خلصنا إلى أن الظروف الحالية المتعلقة بالجائحة قد جعلت شيء من المرونة في تطبيق مبدأ القوة الملزمة للعقد الذي يمس بالمبدأ العام لسلطان الارادة. ومع اتخاذ الدولة عدة تدابير احترازية للحد من انتشار الفيروس أدى ذلك لاستحالة تنفيذ الالتزام بالنسبة للمدين المتعاقد بفعل الجائحة باعتبارها قوة قاهرة ، أو مرهقا له بإمكانية إعمال نظرية الظروف الطارئة ، مما يستدعي استحداث نصوص قانونية تتماشى و الوضع الراهن. Abstract: The contract is considered the law of the contracting parties, and it is not permissible to revoke or amend it except with the agreement of the parties, but exceptional circumstances may occur that implement the obligation cumbersome if not transferred impossible due to an emergency or force majeure. Concerning the issue of the binding force of the contract and the Corona Covid 19 pandemic, we concluded that the current circumstances related to the pandemic have made some flexibility in applying the principle of binding force to the contract, which violates the general principle of the power of the will. With the state taking several precautionary measures to limit the spread of the virus, it implementation the commitment impossible, which led to an imbalance of contractual.
