مآل تنفيذ العقد في زمن جائحة كورونا

Résumé: إهتز توازن العقد في زمن كورونا ، فاختلف الفقه في تكييف جائحة كورونا باعتبارها واقعة مادية ، فتارة اعتبرت صورة من صور القوة القاهرة وذلك عندما نكون أمام استحالة تنفيذ العقد ، وتارة أخرى اعتبرت ظرفا طارئا لصعوبة تنفيذ العقد ، وفي كلا الحالتين نحن أمام سببا أجنبيا لا يد للمتعاقدين فيه و لم يتوقعاه عند إبرام العقد ، فينتهي بذلك العقد بقوة القانون في حالة القوة القاهرة وذلك عندما يكون تنفيذ الالتزام غير ممكنا ، أو نكون أمام الإبقاء على العقد وذلك برفع الارهاق على المدين بالإلتزام . The contract becam eunbalanced in the time of the Covid-19, so the jurisprudence differed in adapting the pandemic as a physicaloccurence, first itwasconsidered as a form of force majeure and that’swhen the execution of the contractis impossible, thenitwasconsidered as an urgent condition whenwe face difficultieswhileexecutingit, and in both cases we have a foreing cause which the contractorsdidn’texpect and they have nothing to do withit, and as a result the contract ends in the case of force majeure and that’swhenexecuting thecommitmentis not possible, or wekeep the contract by reducing the pressure on the committed.
