ضوابط خدمة ما بعد البيع ونتائج عدم الالتزام بها حسب المرسوم التنفيذي 21-244

Résumé: يدرس هذا البحث ضوابط خدمة ما بعد البيع حسب المرسوم التنفيذي 21-244، والنتائج المترتبة عن عدم التزام البائع بها، ويهدف إلى تحديد مضمون خدمة ما بعد البيع وتأصيل أساس الالتزام بها، وكذا بيان شروط قيامها وتنفيذها في التشريع الجزائري بالاعتماد على ما جاء في المرسوم المذكور، كما يهدف إلى ذكر الجزاءات المترتبة على البائع عند عدم الالتزام بالخدمة، وتحديد حالات سقوط هذا الالتزام عليه، ومن أهم نتائج البحث أن خدمة ما بعد البيع هي مجموع الالتزامات التي يجب على البائع تنفيذها بعد عملية البيع، وذلك مقيّد بجملة من الشروط، ومرتبط بالاتفاق العقدي بين الطرفين، وإذا توفرت الشروط ولم ينفذ البائع التزامه فإنه يُلزم بذلك قضائيا، أو يتحمل تسديد الغرامة الماليّة المقرّرة. This research studies the regulations of after-sales service according to executive decree 21-244, and the consequences of the seller's non-compliance with this service. It aims to defining the content of the after-sales service and establishing the basis for its commitment, and stating the conditions for its establishment and implementation in the Algerian legislation, based on what stated in the aforementioned decree. It also aims to mention the penalties incurred by the seller in the event of non-compliance with this service, and to determine the cases of exemption the seller from this obligation. Among the most important results of the research is that the after-sales service is the obligations that the seller must perform after the sale, and this restricted by a number of conditions, and linked to the agreement during the contract. If the conditions are met; and the seller does not perform his obligation, he is obligated by the judiciary, or will be liable to pay the prescribed fine
