شروط الالتزام بخدمة ما بعد البيع في التشريع الجزائري

Résumé: يدرس هذا البحث الشروط الواجب توافرها لقيام الالتزام بخدمة ما بعد البيع، ويهدف إلى بيان مضمون هذه الخدمة في التشريع الجزائري، وتفصيل الشروط اللازمة لقيام الالتزام بها، مع بيان مدى إلزامية كل شرط من هاته الشروط، ومن أهم النتائج التي توصل إليها البحث أنّ الالتزام بخدمة ما بعد البيع له عدة شروط؛ منها ما يتعلق بالشيء المبيع، ومنها ما يتعلق بالمتعاقدين، ومنها ما يتعلق بالمدة الزمنية، وكلها شروط منطقية موافقة لما عليه العرف التجاري، وتهدف إلى ضمان حماية المستهلك. This research studies the necessary conditions for the commitment to the after-sales service. The research aims to statement of the content of this service in the Algerian legislation, and detailing the conditions necessary for compliance with it. In addition, indication of the mandatory degree of each of these conditions. Among the most important results of the research is that the commitment to after-sales service has several conditions; some of it relates to the commodity, some of it relates to the contracting parties, and some of it relates to the period time. In addition, all conditions are logical reasonable, and consistent with commercial custom, and aim to achieve consumer protection
