الأشكال المستحدثة لإثبات الأملاك الوقفية في التشريع الجزائري على ضوء المرسوم التنفيذي رقم:2000-336

Résumé: تهدف هذه الدراسة إلى التعريف بوثيقة الإشهاد الكتابي، وتكييفها القانوني، ومبررات إنشائها، وبياناتها الإلزامية وكيفية إعدادها، سواء تلك المتعلقة بالشاهد أو بالممتلكات الموقوفة، والعدد اللازم من الشهادات. كما تطرقت الدراسة إلى أهم الصعوبات التي قد تواجه إعداد هذه الشهادة، دون إغفال إجراءات إيداعها على مستوى مديرية الشؤون الدينية والأوقاف بعد استكمال نصابها القانوني ، وتسجيلها في سجل أملاك الوقف. حتى يتمكن مدير الشؤون الدينية والأوقاف من الحصول على الشهادة الرسمية بذلك.. Abstract: This study aims to introduce the document of written attestation, its legal adaptation, the justifications for its creation, as well as its mandatory data and how to prepare it, whether those related to the witness or the endowed property, and the necessary number of certificates. The study also touched upon the most important difficulties that may face preparing this certificate, without neglecting the procedures for depositing it at the level of the Directorate of Religious Affairs and Endowments after completing its legal quorum, and registering it in the register of the endowment properties so that the Director of Religious Affairs and Endowments can obtain the official certificate of it.
