دور المجــلـس الدستـــوري في توسيع الكتلة الدستورية

Résumé: ملخص: من أجل المحافظة على سمو قواعد الدستور وعلوها ، أنشأ المؤسس الدستوري الجزائري هيئة بغية المحافظة على التطبيق الصحيح لقواعده تتمثل في المجلس الدستوري ، حيث يعتمد القاضي الدستوري في مراجعته للقوانين بشكل أساسي على الدستور الذي يعد المرجع الأساسي في كل أعماله في بداياته ، ما إن لبث وان وسع من مرجعيته الدستورية واعتمد على ديباجته بالرغم من اختلاف الآراء في البداية بعدم اعتماده ضمن الكتلة الدستورية من خلال المجلس الدستوري الفرنسي ، لتتوسع هذه الكتلة بعد ذلك إلى المعاهدات والأعراف الدولية ، بالإضافة إلى القوانين العضوية والعادية . Abstract: For the sake of conserving the rules of constitution, the Algerian Constitutional Founder established an authority that aims at conserving the right application of its rules embodied in the Constitutional Council. In this context the Constitutional Judge depends mainly in his revision of the rules on the Constitution which is considered the basic reference in all his works at its beginnings. Once broadcast and enlarge his constitutional reference depending on his preamble despite the deference in opinions at the beginning without considering him among the Constitutional Bloc through the French Constitutional Council. After that, this Bloc was expanded to international treaties and norms, in addition to the membership and regular laws.
