حماية المصنفات الإلكترونية في الفضاء الرقمي

Résumé: تعتبر المصنفات الإلكترونية من أهم مكونات بيئة الانترنت نظراً لما تقدّمه من ميزات عديدة تتمثل في السرعة والبساطة. وتشكل البيئة الرقمية خطراً كبيراً على هذا النوع من حقوق الملكية الفكرية لما تتيحه من وسائل عديدة في تسهيل الوصول غير المشروع إلى هذه المصنفات، مما أدى إلى تسارع خطوات التعاون الدولي من أجل توفير حماية كفيلة لهذه المصنفات من الاعتداءات الواقعة عليها، فكانت اتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية التي أدخلت برامج الحاسوب وقواعد البيانات لأول مرة في نطاق الحماية الدولية، إلا أن هذه الحماية لم تكن كافية، مما دعا المنظمة العالمية للملكية الفكرية إلى إبرام اتفاقيتي الانترنت الأولى والثانية لعام 1996. Electronic works are considered one of the most important components of the Internet environment due to the many advantages it offers, which are speed and simplicity. The digital environment poses a great danger to this type of intellectual property rights because it provides many means in facilitating illegal access to these works, which has led to the acceleration of international cooperation steps in order to provide adequate protection for these works from attacks on them , as the Trade Related Aspects Agreement One of the intellectual property rights TRIPS that introduced computer programs and databases for the first time within the scope of international protection, but this protection was not sufficient, which called for the World Intellectual Property Organization WIPO to conclude the first and second Internet agreements of 1996.
