الحماية الإفريقية لحق الفرد في المحاكمة العادلة

Résumé: ملخص: يعتبر الحق في المحاكمة العادلة من الحقوق الأساسية المكفولة في القوانين الوطنية وكذا المواثيق الدولية إذ يمثل هذا الحق مؤشرا على مدى احترام الدولة لحقوق الإنسان فتم تكرسه في الأنظمة الإقليمية لحماية الحقوق والحريات، فكان الميثاق الإفريقي نموذجا لذلك من خلال تدعيمه بآليات للرقابة على مدى الالتزام الدولي بحماية واحترام حقوق الإنسان خاصة أن الهدف الأساسي لإنشاء هذه الآليات هو تجسيد الحماية القانونية عمليا فضلا على تفعيل حق الفرد في التقاضي خاصة أمام الهيئات القضائية للنظام الإفريقي لحماية حقوق الإنسان . Abstract: The right to a fair trial is one of the fundamental rights guaranteed in national laws as well as international conventions, as this right is an indication of the extent of the state's respect for human rights, and it was enshrined in regional systems to protect rights and freedoms, so the African Charter was a model for this by strengthening mechanisms to monitor the extent of the international commitment to protect Respect for human rights, especially since the primary goal of establishing these mechanisms is to materialize legal protection in practice as well as to activate the individual's right to litigation, especially before the judicial bodies of the African system for the protection of human rights.
