أسس الفتيا عند العلامة ناصر الدين اللقاني المالكي ت958 هــ

Résumé: يعتبر العلامة ناصر الدين اللقاني المالكي المتوفى سنة 985 ه من العلماء الذين حازوا رتبة الاجتهاد المذهبي بطريقة التخريج على أصول المذهب كما شهد له العلامة الأجهوري وغيره، ومن ثمرات ذلك أن له فتاوي منثورة في كتب المالكية وغيرهم، فنالت قيمة علمية جليلة بحيث غدت مرجعا لمن جاء بعده من علماء المذهب المالكي حتى بلغ إشعاعها أن أَفَادَ منها أهل المذاهب الفقهية المعتمدة كما أنها تعتبر منهلا تستفيد منه المجامع الفقهية المعاصرة وخاصة في باب المعاملات المالية المستجدة كاعتمادهم على كلام الناصر اللقاني في مسألة بدل الخلو المشهورة، فجاءت هذه الورقة البحثية لتبين الأسس التي بنى عليها الناصر اللقاني فتاويه ونوازله، ومن تلك الأسس: التحرز في الفتيا والبناء على أصول المذهب والتخريج عليها والتعويل على كلام من تقدمه من علماء المذهب المالكي ونصوصهم مع التعليل والاحتكام للعرف والأقيسة ومراعاة الخلاف ويرافق ذلك النظر المقاصدي المتين. The scholar Nasser al-Din al-Laqani al-Maliki, who died in the year 985 AH, is considered one of the scholars who attained the rank of sectarian ijtihad through the method of graduation on the principles of the doctrine, as the scholar al-Ajhuri and others attested to him. One of the fruits of this is that he had fatwas published in the books of the Malikis and others, and they attained great scholarly value such that they became a reference for those who came. After him, among the scholars of the Maliki school of thought, its radiance reached such an extent that the people of the approved schools of jurisprudence benefited from it. It is also considered a source of benefit from contemporary jurisprudential academies, especially in the chapter of contemporary financial transactions, such as their reliance on the words of al-Nasir al-Laqani on the famous issue of the allowance for being alone. This research paper came to show the foundations upon which Al-Nasir Al-Laqani built his fatwas and calamities. Among those foundations are: caution in the fatwa, building on the principles of the doctrine, drawing on them, relying on the words of the scholars of the Maliki doctrine that came before him and their texts with reasoning, resorting to custom and analogies, taking into account disagreement, and this is accompanied by solid intentional consideration.
