Résumé: ملخص: تناولت هذه الدراسة مسألة مدى مشروعية أطفال الأنابيب من الزوج حال موته الدماغي في الفقه الإسلامي هادفة إلى التعرف على ماهية التلقيح الصناعي الخارجي وموت الدماغ، ومن ثم بيان الحكم الشرعي المتعلق بهذه المسألة إذا كان من يطلب ذلك هو الزوجة بقصد الإنجاب من زوجها المتوفى دماغيًا. وقد تم الوقوف على حقيقة التلقيح الصناعي الخارجي وموت الدماغ، وكذلك أهداف التلقيح الصناعي وأسبابه وحالاته، حيث ظهر أن التلقيح الصناعي بين الزوجين من المسائل المهمة في التشريع الفقهي، وبأن الهدف من القيام به هو الحصول على الولد في حق العاجز عن ذلك بالمعاشرة الطبيعية، وقد تبين كذلك أنه يحدث وفق شروط معينة ترتبط بالزوجين وأخرى ترتبط بإجراء التلقيح الصناعي من النواحي الإدارية والطبية. وقد خلص البحث كذلك إلى أن حكم التلقيح الصناعي الخارجي بين الزوجين حال الموت الدماغي من الأمور التي قد اختلف العلماء على مشروعيتها بين مجيز ومعارض، حيث رجح الباحث في ذلك رأي المجيزين بشروط يجب الأخذ بها ومراعاتها من الناحية الشرعية. الكلمات الدالة: التلقيح الصناعي، موت الدماغ، أطفال الأنابيب، الإخصاب . Abstract:This study has dealt with the issue of external artificial insemination between spouses in the case of brain death in Islamic jurisprudence. It aims at identifying what artificial insemination and brain death are, and then clarifying the Islamic rules regarding this issue if the applicant is the wife for the purpose of procreation from her brain-deceased husband. The fact of artificial insemination and brain death, as well as its purposes, causes have all been investigated. It has been found that artificial insemination between spouses is an important issue in jurisprudential legislation, and that its ultimate goal is to obtain offspring in away similar to those who cannot reproduce through normal intercourse. It has also been found that the artificial insemination often occurs under certain conditions related to the couple and others related to the IVF procedures from both administrative and medical perspectives. The researcher has remarked that artificial insemination between spouses in the event of brain death is one of the debatable issues that some scientists allow whereas others forbid. Finally, the researcher agrees with the view that permits artificial insemination under certain conditions that must be considered from a legitimate perspective.
